HIPAA Compliant Backup Service

A brief history of HIPAA

HIPAA stands for The Health Insurance Portability and Accountability Act of 1996 the act requires that the data related to an individuals health insurance be private and needs to be safeguarded. It requires the entities storing such data to have a strict compliance to guidelines before they are allowed to provide service. It was the result of efforts by the federal government to ensure healthcare data practices allow patients to easily move jobs, insurance, and/or healthcare providers.

The goals and objectives of this legislation are to streamline industry inefficiencies, reduce paperwork, make it easier to detect and prosecute fraud and abuse, while enabling workers of all professions to change jobs easily even if they (or family members) had pre-existing medical conditions.

HIPAA requires the ability to establish and maintain reasonable and appropriate administrative, technical, and physical safeguards to ensure integrity, privacy, security, and availability of information.

What does this mean for entities handling the information

Administrative Safeguards

A number of administrative requirements must be observed in order to meet HIPAA compliance. The standards cited in the Security Rule include a provider’s security management process, assigned security responsibilities, workforce security, information access management, security awareness training and contingency planning.

Physical Safeguards

These are related to physical infrastructure such as locks and secure access areas. The Physical Safeguards in the HIPAA Security Rule include standards for facility access controls, workstation use and security and device and media controls.

Controls must govern the introduction and removal of hardware and software from the network. (When equipment is retired it must be disposed of properly to ensure that PHI is not compromised.)

Access to equipment containing health information should be carefully controlled and monitored.

Access to hardware and software must be limited to properly authorized individuals.

Technical Safeguards

A minimum of 128-bit encryption, deletion and destruction of data, which can be done according to the Department of Defense’s standards, set forth in the National Industrial Security Program Operating Manual. And if you don’t encrypt data at rest, then it must be destroyed.

Once you have a clear understanding of all the detailed requirements for compliance you would see that it would make sense to use a backup provider service than implement all of these yourself. Office 365 vs White Label Hosted Exchange 2013: Which One is right for Resellers?

The right choice in cloud hosting goes a long way in eliminating the hassles of server management, and if acquired at a reasonable price point you can create a very profitable and stable line of business.
 
But with so many proponents for each solution lobbying for a wide range of options, the right choice has suddenly become a difficult choice for carriers. Do IT providers hand the entire relationship to Microsoft?
 
Office 365
 
Probably the main thing in Office 365’s favor is that its a suite of applications and not just email but with that also comes $6, $10, or $14 per user per month billing responsibilities.
 
It also helps that it already comes bundled with some rather excellent features, like OneNote, SharePoint, and Lync, which need to be bought as add-ons with other solutions. Not only that, Office 365 updates come fairly often so it’s a nice option for keeping office in line from year to year.
 
On the downside, Office 365 does limit the number of email recipients for every 24-hour period and can only support 300 users per account so medium to larger situations at the lowest price point are not supported. This can be a hindrance to a lot of companies but especially to IT providers as each 365 instance has it’s own separate login and web panel. Multi-tenancy for MSP’s is not a consideration and makes it very difficult to provide distributor level management. Not only that, Office 365 support can be a bit difficult to engage if purchased directly. Users have to go through a sizeable and complicated knowledge base to find answers and phone support is offshore. Techincal issues require language nuance and trust so most customers dont want someone they have never met remoting into their computers or network environments.
 
From a financial perspective, Office 365 costs quite a bit more than our $2 white label hosted exchange 2013. Furthermore, Office 365 is strictly commission-based and doesn’t have the same earning potential as white label solutions. This means that the client has to pay Microsoft directly for the Office 365 service, which leaves you with no paperwork or collection of the transaction. When the transaction is complete you will then receive a commission check, a very small one, from Microsoft and you are out of the picture.
